Demerit Points

Demerit Points

Certain driving related offences come with demerit points, a system managed and operated by the Ontario Ministry of Transportation. When convicted of most offences under the Highway Traffic Act, drivers accrue demerit points. Every licenced driver in Ontario begins with zero points. From then on, depending upon convictions, points are acquired. For example: A fully licenced driver acquiring 6 demerit points will be informed by the Ministry of Transportation as to their driving record. You may have to attend an interview and explain why you should retain your driver's licence. Failure to attend the interview may result in a licence suspension.

At 9 demerit points, the driver may have to attend an interview and explain why their driver's licence should not be suspended and the driver may be re-tested. Failing the test will result in a cancellation of the licence. Failing to attend the interview or failing to provide valid reasons for keeping the driver's licence may result in licence suspension. 15 demerit points will result in a 30-day suspension. Failure to surrender the licence upon suspension may result in suspension of up to two years.
